These Terms of Use govern your access to and use of the Embera platform. By using Embera, you agree to these terms. If you don't agree, don't use the service. These terms are written in plain English because you shouldn't need a lawyer to understand them.
Accepting These Terms
By creating an account, accessing, or using Embera, you agree to these Terms of Use and our Privacy Policy. If you're using Embera on behalf of a company, you represent that you have authority to bind that company to these terms.
Your Account
You're responsible for keeping your account credentials secure. Don't share your login. If you suspect unauthorized access, notify us immediately at security@embera.co.
You're responsible for all activity that happens under your account. If you add team members, you're responsible for their compliance with these terms.
Acceptable Use
Use Embera for lawful purposes only. Don't use it to harass, defraud, or harm others. Don't upload malicious code. Don't attempt to bypass security measures or access data you're not authorized to access.
Don't reverse engineer the platform, scrape data at scale, or build competing products using Embera's technology.
Your Data
You retain all rights to the data you upload to Embera. We only use it to provide the service and support. You can export or delete your data at any time. See our Privacy Policy for details.
SMS & Text Messaging Terms
By providing your mobile number and opting in, you consent to receive SMS text messages from Embera related to your account, crew operations, scheduling and dispatch alerts, and demo or support requests. Consent to receive text messages is not a condition of any purchase.
Message frequency varies based on your account activity. Message and data rates may apply, depending on your mobile carrier and plan.
You can cancel SMS messages at any time by replying STOP to any message. After you reply STOP, we will send a confirmation message and you will no longer receive texts. For help, reply HELP or email support@embera.co.
Carriers are not liable for delayed or undelivered messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes; see our Privacy Policy for details.
Subscription & Billing
Paid plans are billed monthly or annually in advance. You can cancel at any time — monthly plans stop at the end of the billing cycle, annual plans continue until renewal.
Refunds are available within 30 days of initial purchase. After 30 days, no refunds are issued for unused time on a subscription.
Service Availability
We target 99.9% uptime and back it with an SLA on Professional and Enterprise plans. Scheduled maintenance is announced in advance. Unplanned downtime is addressed immediately and post-mortems are shared with affected customers.
Intellectual Property
Embera owns the platform, software, and brand. You own your data. You grant us a limited license to use your data only as needed to provide the service. Nothing in these terms transfers ownership of our IP or yours.
Termination
You can terminate your account at any time. We may terminate or suspend accounts that violate these terms, engage in illegal activity, or fail to pay. Upon termination, we provide 30 days to export your data before deletion.
Disclaimer of Warranties
Embera is provided "as is" without warranties of any kind. We work hard to make it reliable and useful, but we can't guarantee it will be error-free or meet every specific need. Use it accordingly.
Limitation of Liability
To the maximum extent permitted by law, Embera's total liability is limited to the amount you paid us in the 12 months preceding a claim. We're not liable for indirect, incidental, or consequential damages.
Changes to These Terms
We may update these terms occasionally. Material changes will be announced at least 30 days in advance. Continued use after changes constitutes acceptance.
